PLEASE READ THESE TERMS OF USE (“TERMS”) CAREFULLY. THEY SET FORTH THE LEGALLY BINDING TERMS FOR YOUR USE OF THE SERVICE. THEY REQUIRE YOU TO ARBITRATE DISPUTES AND WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION.
Introduction
Covid 843 Refund (the “Service”) is operated by 1776ing, LLC (“1776ing,” “we,” “our,” or “us”). By registering for, accessing, or using the Service, you accept these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
The Service
The Service is software that helps eligible taxpayers and their tax professionals prepare a Form 843 claim for refund and abatement of penalties and interest assessed during the COVID-19 disaster period (January 20, 2020 – July 10, 2023) under I.R.C. § 7508A(d). You upload your IRS transcript; the Service reads it, computes an estimate, and — after payment — generates a Form 843 package for you to review, sign, and file.
1776ing is not a law firm or an accounting firm and does not provide legal, tax, accounting, or investment advice. Using the Service does not create an attorney-client or accountant-client relationship. The Service is a self-directed preparation tool; you are responsible for reviewing all computations and citations, and for signing and filing your claim in your own name. You should consult a qualified tax or legal professional about your specific situation.
No guarantee of outcome
We do not guarantee that the IRS will grant any refund or abatement, in whole or in part. The legal positions reflected in the Service rest on I.R.C. § 7508A(d) and judicial decisions including Kwong v. United States and Abdo v. Commissioner; certain positions are asserted protectively and may be contested by the IRS. Estimates shown before filing are informational and may differ from the final computed claim or the IRS’s determination.
Consent to use of tax return information (I.R.C. § 7216)
By using the Service, you consent to 1776ing’s use and disclosure of your tax return information for the purpose of providing the Service — including reading your transcript, computing your claim, preparing your Form 843 package, and using the service providers described in our Privacy Policy to do so. We will not use or disclose your tax return information for any other purpose without your separate consent or as required by law. You may decline, but we then cannot provide the Service.
Eligibility & accounts
You must be at least 18 and able to form a binding contract. You agree to provide accurate, complete information and to keep it current. You are responsible for your account credentials and for all activity under your account, and you agree to notify us promptly of any unauthorized use. We may refuse, suspend, or terminate access in our discretion.
Fees
Seeing your estimate is free. Generating your Form 843 filing package costs a flat $500 per filing, charged through our payment processor before the package is produced. Because the package is generated and delivered to you immediately upon payment, fees are non-refundable except where required by law. We may change our fees prospectively.
Intellectual property & your license
The Service and its content are owned by 1776ing or its licensors and are protected by law. We grant you a limited, revocable, non-transferable license to use the Service for your own Form 843 matter. The completed Form 843 package we generate for you is yours to review, sign, and file. You retain ownership of the information and documents you provide and grant us the rights needed to operate the Service and prepare your filing.
Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RESULT WILL MEET YOUR REQUIREMENTS. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, 1776ING AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE FILING GIVING RISE TO THE CLAIM.
Indemnification
You agree to indemnify and hold harmless 1776ing and its affiliates from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, the information you provide, or your violation of these Terms or applicable law.
Dispute resolution; arbitration & class-action waiver
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, and you waive the right to participate in a class action, to the fullest extent permitted by law. These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules.
Changes & termination
We may update these Terms from time to time; the updated version will be posted here with a new “Last updated” date, and your continued use constitutes acceptance. We may suspend or terminate the Service or your access at any time.
